These Terms and Conditions (the "Terms") govern your use of this website and any order you place with Wine & Spirits, a licensed Illinois alcoholic beverage retailer located at 142 Sibley Blvd, Dolton, IL 60419 ("we", "us", "our"). By using this site or placing an order, you agree to these Terms. If you do not agree, please do not use the site.

1. You must be 21 or older

You may only use this site and place orders if you are at least 21 years of age. By placing an order you represent that you are 21 or older, that any person receiving the order is 21 or older, and that the alcohol is for personal consumption and not for resale.

A valid, unexpired government-issued photo ID showing an age of 21 or over is required at every handoff, whether the order is picked up in store, delivered locally, or shipped by carrier. Our staff and our carriers will refuse any handoff where ID cannot be produced, where the ID appears invalid, or where the recipient appears intoxicated. Refused orders are returned to the store and refunded less any delivery or carrier fees.

2. Accounts

You are responsible for the accuracy of the information on your account and for keeping your password confidential, and for activity that occurs under your account. Tell us promptly if you believe your account has been used without your permission.

3. Orders and acceptance

Your order is an offer to buy. No order is accepted until we confirm it and it leaves our store. We may refuse, limit, or cancel any order, including after a confirmation email, for reasons that include suspected resale, quantity limits on allocated or limited-release products, stock that turns out to be unavailable, pricing or description errors, an address outside an area we may lawfully serve, or a failed age or identity check. If we cancel an order you have already paid for, we refund it in full.

Allocated and limited-release bottles may carry a limit of one per household, applied at our discretion.

4. Prices, errors and taxes

Prices are shown in US dollars and may change without notice. Applicable state and local taxes are calculated at checkout. Despite our efforts, a product may occasionally be listed at an incorrect price or with an incorrect description, image, vintage, proof, or availability. Where that happens we may correct the error and cancel or refuse any order placed at the incorrect price, including after the order was submitted.

5. Payment

Payment is processed at checkout through our payment providers. By submitting payment information you represent that you are authorized to use the payment method. We do not store full card numbers.

6. Pickup, local delivery and shipping

Our delivery zones, minimums, fees and shipping terms are described on our Shipping & Delivery page, which forms part of these Terms. Delivery windows are estimates and may shift during holidays, severe weather, or carrier delays. Alcohol cannot be left unattended: it cannot be left at a door, with a neighbor, in a lobby, or with a front desk, and someone 21 or older must accept it in person with ID.

Title and risk of loss pass to you at the time of handoff in Illinois. We do not ship to states, counties or municipalities where shipment of alcoholic beverages to consumers is prohibited, and we may cancel any order destined for such an area.

7. Returns and refunds

Alcoholic beverages are generally not returnable once they have left our custody, as required by Illinois law. Our refund policy describes the situations in which we can help, which include bottles that arrive damaged, orders that are incorrect, and orders that are refused or undeliverable. Contact us within a reasonable time and keep the product and its packaging.

8. Rewards, membership and promotions

Points, membership tiers and coupons have no cash value, are not property, cannot be sold or transferred, and may be modified, suspended or discontinued at any time. Points are earned on qualifying purchases only and may be reversed if the underlying order is cancelled, returned or refunded. We may adjust or remove points, close an account, and cancel orders where we reasonably believe a program has been abused, including through duplicate accounts, fraudulent orders, or resale.

Promotional codes may carry their own conditions, including minimum spend, product exclusions, expiry dates, and limits on how they combine with other offers.

9. Product information

Labels, vintages, bottle designs and stated proof can change between production runs, and images on the site may show a previous label or vintage. We make no promise that a particular vintage, batch, barrel or label variant will be the one supplied. If a specific vintage or batch matters to you, contact the shop before ordering.

10. Acceptable use

You agree not to use this site to break the law, to buy alcohol for anyone under 21, to buy for resale, to interfere with or overload the site, to scrape or harvest data, to attempt unauthorized access to any account or system, or to misrepresent your identity or age.

11. Reviews and other content you submit

If you submit a review, comment, photograph or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use, display and reproduce it in connection with our business. You are responsible for what you submit and confirm you have the right to submit it. We may remove any content at our discretion.

12. Intellectual property

This site, its text, photography, graphics, logos and layout are owned by us or our licensors and are protected by copyright and trademark law. Brand names, bottle labels and producer marks belong to their respective owners and appear here to describe the products we sell.

13. Third-party links and services

This site links to services we do not control, including payment processors, mapping services and social platforms. We are not responsible for their content, practices or availability, and your use of them is governed by their own terms.

14. Disclaimer

The site and the services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, secure or error-free, or that product descriptions are complete, current or error-free.

15. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, arising out of or relating to your use of the site or any product purchased through it. To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms limits liability that cannot be limited under applicable law.

16. Indemnity

You agree to indemnify and hold us harmless from claims, damages and expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the site, or your violation of any law or the rights of a third party.

17. Governing law

These Terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules. You agree that the state and federal courts located in Cook County, Illinois have exclusive jurisdiction over any dispute arising from these Terms or your use of this site.

18. Changes to these Terms

We may update these Terms from time to time. The updated version takes effect when posted, and the "Last updated" date above will change. Continued use of the site after an update means you accept the revised Terms.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions stay in force.
